These Terms of Sale apply to every purchase you make through the Yiwu Market Australia retail store. You are buying from [COMPANY LEGAL NAME] (ABN [ABN]) (we, us). We are the seller and the importer of the goods.

Our Shipping & Delivery Policy and Returns & Refunds Policy form part of these Terms.

The version of these Terms that applies to your order is the version published when you placed it. We may change these Terms, but changes do not affect orders already placed.

2. Orders

Your order is an offer to buy. A contract is formed when we send you an order confirmation.

We may decline an order, or part of one, before confirming it — for example where an item is out of stock, a price or description was published in error, or we cannot deliver to your address. If we decline after taking payment, we refund you in full.

If we cannot supply goods you have paid for within the delivery estimate published for your order, we will tell you and you may choose a refund or, where available, a replacement.

3. Price, GST and payment

Prices are in Australian dollars and include GST.

Delivery charges are set out in the Shipping & Delivery Policy and are shown before you pay. Delivery charges include GST.

Payment is taken in full when you place your order.

4. Delivery, risk and title

We deliver within Australia only.

Risk in the goods passes to you when they are delivered to the address you gave us. Until then, loss or damage in transit is ours.

Title passes to you when we receive payment in full.

5. Your rights under the Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law.

Where a failure is major, you choose the remedy. Where it is not major, we may choose to repair, replace or refund.

Subject to the above, our liability for any other loss is limited to the amount you paid for the goods.

6. Product information

Our products are imported. Where repair facilities or spare parts are not available for a product, we say so on that product's page before you buy.

Where a product has characteristics that affect its finish or appearance — hand-finishing, natural material variation, tool marks — we describe them on that product's page before you buy.

Colours shown on screen are indicative.

7. General

These Terms are governed by the law of [STATE], Australia.

If any provision is unenforceable, it is severed and the rest continues.
